I. QUESTION PRESENTED What, if any, significant flaws are present in the existing Will of Paul Dutton that were not altered by the changes he has requested? II. SHORT ANSWER The significant flaws that are present in the existing Will of Paul Dutton are a lack of self-proving affidavit, failure to provide for the payment of GST tax and allocation of exemption, and ambiguity of section C in Article I. III. STATEMENT OF FACTS Paul Dutton has asked us to alter his estate plan, which previous included an inter vivos trust created in 2013 and a previously executed Will leaving all of his property to his spouse, Erika Dutton. He has asked that we update his current Will to create a two trust plan, consisting of a marital trust and family trust. I have conformed the terms of his new will to this request but now would like to direct your attention to some significant flaws in the language of the original will, which have not been changed, and suggest some solutions to these flaws. IV. DISCUSSION The three significant flaws that I have been able to identify in the original Will include: no self-proving affidavit, failure to require that any GST tax payable on account of his death be paid as an expense of the estate, and ambiguity in the clause located at Article 1 section C. I will discuss each problem below and the proper action or changes that must be taken to remedy this flaw. a.
